PESHAWAR: The Peshawar High Court on Monday dismissed the bail petition of a man arrested by the Federal Investigation Agency (FIA) on the charge of hacking a married woman’s Facebook account and uploading objectionable material on it.

Justice Roohul Amin Khan of a single-member bench observed that suspect Rizwanul Haq, a resident of Bhara Kahu, Islamabad, didn’t deserve to be freed on bail as he was involved in a heinous crime.

Lawyer FM Sabir and inspector Adnan Khan appeared for the FIA and said the suspect had ruined the life of a Nowshera woman, mother of two, as his unlawful and unethical acts led to her divorce.

FM Sabir said the suspect had hacked Facebook account of the woman, who was married to a man in Islamabad and was living a happy life.

He said the suspect not only uploaded objectionable contents on her Facebook account but also shared that material with her husband and mother-in-law.

The lawyer said the woman was divorced by her husband due to the illegal and unethical acts of the suspect and that the suspect continued with those acts to defame her.

He added that finally, the woman filed a complaint with FIA, which charged the suspect under sections 36 and 37 of the Electronic Transaction Act and Section 30 of the Telegraph Act. The lawyer for the suspect claimed his client was falsely implicated in the case and that there was no evidence available to show that his client was involved in the hacking of the woman’s Facebook account.

He said it was a case of further inquiry and that his client deserved to be granted bail.

BAIL DISMISSED: Additional district and sessions judge Fareed Khan Alizai on Monday dismissed the bail petition of a man arrested on the charge of creating a fake Facebook account of a woman and uploading objectionable contents on it. Suspect Zahid Khan, a resident of Hakeemabad area in Nowshera, was arrested few days ago after a complaint was lodged with the cyber crimes wing of FIA by a Swabi resident.

The complainant alleged that the suspect had created fake Facebook account of his (complainant’s) sister. Zahid Yousaf and Hassan Ali, lawyers for the complainant, said the suspect was charged under the Electronic Transaction Act and therefore, he was not entitled to bail under the said law.
