PESHAWAR, June 18: A division bench of the Peshawar High Court on Wednesday dismissed an appeal and upheld capital punishment awarded to a person by a Qazi court for stabbing a man to death.

The bench comprising Justice Malik Hamid Saeed and Justice Ijazul Hassan observed that there was enough evidence against the appellant, Zar Badshah, and he deserved no leniency.

The appellant had faced trial for killing Faqir Shah on April 10, 1999, in the jurisdiction of Och police station. He was convicted  by the Izafi Zila Qazi (additional district and sessions judge), Lower Dir, and sentenced to death on March 7, 2003.

The wife of the appellant had deposed against him and stated that on the  day of the occurrence, her husband had brought Mr Shah to his residence. Later, she claimed, she spotted blood stains in the room whereas the guest  was missing.

She informed her brothers, who told the police about the incident. The police arrested the appellant and came to know that he had stabbed the deceased with a dagger and put the body in a box. The police also recovered the dagger.

Advocate Essa Khan appeared for the complainant and argued that the body had been recovered from the residence of the appellant and the weapon of offence was recovered by the police.   He said the evidence on record connected the appellant with the commission of the offence and his wife had deposed against him.
