PESHAWAR, April 24: A two-member bench of the Peshawar High Court on Thursday set aside conviction of a former senior member of Board of Revenue and remanded the case back to the accountability court.
The bench comprising Justice Abdur Rauf Lughmani and Justice Qaim Jan Khan also granted bail to the appellant, Abdul Hamid Khan.
The appellant claimed that the trial court had overlooked various important aspects of the case while sentencing him.
The accountability court presided over by Miftauddin Khan had convicted the appellant on Jan 30, 2002, and sentenced him to 10 years rigorous imprisonment. The court had fined him Rs45.45 million with forfeiture of his assets.
The appellant had faced trial for possessing assets disproportionate to his known sources of income.
According to NAB, the properties possessed by the appellant are: two plots worth Rs5.3 million; three houses worth Rs27.7 million; national savings certificates to the tune of Rs13.7 million and foreign currency accounts to the tune of Rs4.80 million.
