HYDERABAD, April 10: The Sindh High Court, Hyderabad circuit bench, on Thursday issued notice to the additional advocate general, Sindh, for April 17 on a constitutional petition, filed by a woman, seeking registration of an FIR against the SHO, Jati police station, and a councillor of union council, Ghulam Mustafa, for subjecting her to rape.
The woman, Haseena, cited district police officers (DPOs) of Badin and Thatta, SHOs of Golarchi and Thatta police stations, Ghulam Mustafa and five other private persons as respondents. Advocate Aslam Bhatti represented her.
Ms Haseena, 22, claimed in the petition that on March 7 she had married, Mohammad Ali Lund, and had executed her free will before the judicial magistrate, Malir, on March 8.
After one week of her marriage, respondent Ghulam Mustafa Lund, s/o Usman Lund, who was councillor of the area union council, along with the SHO, Jati police station, and other private respondents, armed with hatchets took her away to some unknown place and subjected her to torture and rape.
She claimed that after two days of the incident, her husband came to know about her detention within the jurisdiction of the police station.
She said that her husband approached some respectable people of the area for securing her release and these people also contacted the SHO but he did not pay any heed to their request.
She stated that on April 4 she fled from the area and went to the residence of her husband in Golarchi and told him that from March 14 to April 4 Ghulam Mustafa had subjected her to rape, and added that he also solemnized her Nikkah with another person despite the fact that she was married to Mohammad Ali Lund.
She claimed that thereafter she held a press conference in Badin, narrating all the facts about her case and also went to the SHO, Golarchi police station, to lodge her complaint but the SHO concerned did not register her FIR although serious charges of rape and kidnapping were involved.
She said that she belonged to a Baloch tribe and her father, brother, and other relatives wanted to kill her and her husband.
She disclosed that the SHOs of Jati and Golarchi police stations were also trying to involve her and her husband in a false criminal case.
She prayed the court to direct the DPOs to file a detailed list, containing the details of cases against her and her husband.
She further prayed that the SHO, Golarchi police station, should be directed to register an FIR against Ghulam Mustafa and the SHO, Jati police stat-ion, for committing offence of Zina.
She also sought protection from the court for her and her husband.
She said that the police and private respondents should be restrained from harassing, humiliating, and maltreating her and her husband.
