HYDERABAD, April 9: A division bench of the Sindh High Court, Hyderabad circuit bench, on Wednesday directed the additional advocate general, Sindh, Masood A. Noorani, to provide details of all the U-turns located on the Super Highway.

The bench said that the details should also include all those U-turns which were illegally created.

The court has fixed a hearing for May 5.

The order was passed on the constitutional petition of one Ghulam Nabi Abbasi, who owns a petrol pump near the Jamshoro toll plaza. He was represented by Advocate Ayaz Latif Palejo.

The court had earlier issued notices to the in charge, National Highway Police, administrative officer-3, National Highway & Pakistan Motorways police, and the additional advocate general, Sindh, on the petition, challenging removal of U-turns from the Super Highway.

The petitioner prayed the court to restrain the respondents from removing or bulldozing U-turns.

He claimed that there were several trucking stations on the highway throughout and that he was fulfilling all requirements including paying the required fees. He added that on April 11, 2002 four persons, who claimed to be National Highway Authority (NHA) officials, arrived at his pump and demanded Rs50,000 failing which they would remove the U-turns thus rendering him penniless.

He mentioned 16 points on the Super Highway where hotels and petrol pumps and other business houses were set up.

His lawyer argued that discrimination always involved an element of unfavourable bias to common citizens, which was violation of article 25 of the Constitution.

He prayed the court to declare that the threats issued for removal of U-turns were in violation of the equality of citizens and natural justice.
