HYDERABAD, April 2: A division bench of the Sindh High Court, Hyderabad, on Wednesday directed the SHO and the in charge of the investigation wing, Town police station, Mirpurkhas, to produce a woman, Ambreen alias Parveen, who apprehended she and her husband might be killed on the pretext of Karo-kari, before the court.

The bench, comprising Justice Shabbir Ahmad and Justice Mabqool Baqar, passed the order on a constitutional petition, filed by Ambreen alias Parveen.

Ms Ambreen cited the DPO, Mirpurkhas, SHO, Town police station, Yasmin and Shamim, the sister and mother of the petitioner respectively, and Mohammad Ashraf, the husband of Yasmin, as respondents.

Ms Ambreen in the petition said she was engaged to a man, Ghulam Mohammad. She said after her father’s death her mother married Shahzad Ahmad Brohi. She said her mother wanted her to marry Mohammad Azam, who did not have a good character.

She said she had appeared before the judicial magistrate on Feb 26, submitting an affidavit that she wanted to marry Ghulam Mohammad. She said they married on Feb 27.

She maintained the respondents were threatening her that she and her husband would be killed on the pretext of Karo-kari.

She said her elder sister, Yasmin, had lodged an FIR under the Zina Hudood Ordinance at the Town police station, Mirpurkhas, by distorting facts.

The petitioner said the police had raided her house to arrest her husband and his relatives.

She said she had taken shelter in her neighbours’ house.

She prayed the court to declare their marriage legal.

She said the police should be directed not to harass her and her husband.

The SHO, Town police station, Mohammad Ayub Dars, in his statement before the court, said that on the complaint of Ms Yasmin, a kidnapping case was registered against Ghulam Mohammad, Qaiser, Shabban, Karim Bux, Ghulam Haider and Ms Panahi.

He said the FIR was handed over to Naeem Ashraf for investigation and the accused were arrested, adding that an interim charge-sheet under 344 CrPC was submitted and later the “abducted” woman was recovered by the police.

The SHO said she was produced before the judicial magistrate for her statement wherein she denied the charges levelled against her husband.
