HYDERABAD, Nov 17: The circuit bench of the Sindh High Court has taken serious notice of the anomalies in the Anti-Car Lifting Cells (ACLCs) of Hyderabad and Karachi.

The high court circuit bench the other day directed the DSP, ACLC, Hyder Bakhsh Khoso, to produce the entire record of vehicles seized by him under Section 550 of the CrPC from all the districts within the territorial jurisdiction of the high court within 10 days.

Passing the order, Justice Mohammad Moosa K. Leghari ordered the district and sessions judge, Hyderabad, to ensure the production of entire record of the cases pertaining to the Anti-Car Lifting Cell, available with all the magistrates under his jurisdiction.

The DPO, Hyderabad, the DSP, Hyderabad, the DSP, Karachi, ACLC, and SIP Saalim Rind have been directed to appear in person in the court.

The DPO, Hyderabad, has also been asked to produce all relevant record, including photostat copies of all such FIRs pertaining to seizure of vehicles.

The court also directed that the photostat copies of the relevant record should be deposited with the court’s additional registrar, besides directing the deputy registrar to scrutinise the same.

The court also asked the deputy registrar to submit his report on Nov 25.

Justice Leghari directed the Assistant Inspector General of Police, Criminal Division Sindh, Karachi, Pir Syed Hassan Shah Rashidi — who purportedly signed a confidential report in connection with a petition dated July 24, 2002, in respect of a vehicle — to ensure the appearance of Imtiaz Ali Isani and Sadat Ali, the examiners, in the court on the next date of hearing along with relevant record.

The judge directed that a copy of the order should be sent to the secretary, home department, and the provincial police officer (the IGP, Sindh) with a directive to ensure the production of record and the attendance of the police officials.

The order was passed during the course of hearing of a constitutional petition filed on behalf of Mohammad Anees Rajput.

The petitioner had cited Saalim Rind of the ACLC, Hyderabad, and the DSP, ACLC, Karachi, the SHO of the Bhittai Naggar police station as respondents.

He had sought registration of a case against the DSP and the in-charges of the ACLCs of Hyderabad and Karachi.

The petitioner accused the respondent police officials of snatching his car (ABH-930) on July 11, 2002.

He said that the respondent police officials were accompanied by Ehtesham alias chief, who is an employee of an insurance firm of Karachi.

The petitioner also accused the officials of demanding Rs100,000 in bribes through their sub-ordinate staff, besides accusing Ehtesham of deprived him of Rs16,000 in cash.

He said that the car remained untraceable to date.

Justice Leghari observed that DSP Hyder Bakhsh Khoso and Rind have made mockery of law and have started violating the law under the garb of enforcing the law. He maintained that the facts had been twisted by the DSP and the SIP, resulting in violation of the fundamental rights of the petitioner.
