KARACHI, Oct 31: A division bench of the Sindh High Court adjourned on Thursday the hearing of a constitutional petition filed by Syed Faisal Ali Sabzwari of the Muttahida Qaumi Movement, the nominated candidate from PS-118 Karachi, to Friday.

The bench consisted of Justice Ghulam Rabbani and Justice Zawwar Hussain Jafri.

Mr Sabzwari has prayed the court to direct the Election Commission to notify the result of PS-118 by gazette notification in accordance with law and on the basis of the result which has been provided to him by the returning officer through consideration statement and result of vote count.

He claimed that the Election Commission had no power under the law to issue direction to the returning officer under conduct of the Election Commission Order, 2002 or the Representation of People Act of 1976 for issuing order for a vote recount.

The petitioner prayed the court to issue prohibitory injunction restraining the Election Commission from holding election for the reserved seats for women for the Sindh assembly till the publication of the result of PS-118 Karachi in the official gazette.

PS-11: A division bench of the Sindh High Court put off on Thursday the hearing of a constitutional petition filed by Imtiaz Sheikh, the chairman of the Sindh Democratic Alliance, to Friday.

The bench comprised Justice Ghulam Rabbani and Justice Zawwar Hussain Jafri.

Mr Sheikh had prayed the court to declare that after the issuance of gazette notification declaring him the winner from PS-11 Shikarpur-III constituency, claiming that the Election Commission had no powers to alter the same and such powers were only and exclusively available with election tribunal.

The petitioner prayed the court to restrain the Election Commission from passing any adverse order against him in respect of October 20, 2002, notification declaring him to be the winning candidate from PS-11 Shikarpur- III.

He also prayed the court to suspend the operation of the order dated October 28, 2002, passed by the Election Commission recalling the earlier gazette notification dated October 20, 2002, to the extent of the petitioner.— PPI
