PESHAWAR, Oct 17: The Supreme Court here on Thursday took exception to the continuous non-compliance of a court’s order, and summoned the secretary and director of the provincial education department to the court.

A two-member bench of the top court, comprising Justice Mian Mohammad Ajmal and Justice Tanveer Ahmad Khan, directed the additional director of Education Department, Hidayatullah Khan, to strictly comply with the court’s order and the two respondents should positively appear before the court on Oct 18.

Despite repeated orders of the Supreme Court the Education Department has not been producing record pertaining to the case of an official, Muhammad Ali Shah, whose leave to appeal petition has been pending before the Supreme Court.

The petitioner is aggrieved with an order of the North West Frontier Province Services tribunal following which he filed the instant petition before the top court.

The bench first took up the petition for hearing on Tuesday, but the additional advocate-general, NWFP, Ms Mussarat Hillali, requested for adjournment as the department had not produced the record.

The case was again taken up for hearing on Wednesday, but due to non-availability of the record it was adjourned to Thursday.

The bench had directed the officials concerned that till Thursday’s noon the record should be produced.

Ms Hillali submitted before the bench that despite her repeated requests the department had not produced the record.

The additional director, Hidayatullah, informed the bench that the director was in Karachi, therefore he could not turn up before the court. The bench directed that the said two officials should appear on Friday irrespective of the fact where they were.
