KARACHI, June 24: A division bench of the Sindh High Court ordered on Monday the DSP Mauripur and the SHO of Mauripur police station to show cause why cases of unlawful confinement should not be registered against them.

The bench was hearing a constitutional petition filed by Mohammed Javed against the illegal detention of three persons, Jamal, Owais and another man.

The bench earlier perused a report by the Nazir of the SHC, Moinuddin Ahmed, according to which the detainees were found in Mauripur police station. The report said the detainees informed him (Nazir) that they had been in the custody of police since June 13.

The Nazir, who inspected the record of the police station, also said he found no entry about the detainees, nor had police obtained their remand from any court of law.

When the matter came up for hearing, DSP Anwar Soomro, inspector Javed Iqbal and SI Shaukat Mehmood Chaudhry were present in the court.

On a query from the court, the SHO said the detainees were kept in the police station on the orders of the DSP. The DSP expressed ignorance about the the custody of the detainees.

After these statements by the police officials, the court put off further hearing to June 28, while ordering the SHO of Mauripur police station to appear in the court.

The court in its order on Monday said: “It is a serious matter demonstrating plain defiance of law by persons claiming to be responsible for law enforcement.”

The court then ordered all the three respondent police officials to file comments and to show cause why they should be fined to pay compensation to the the three men for their illegal detention.

CONTEMPT CASE: The same division bench of the High Court of Sindh put Rashid Saeed, the Superintendent of the Central Prison Karachi, on notice in a contempt of court application.

The application was moved by counsel for the petitioner, former senator Islamuddin Shaikh, who was tried and sentenced by an accountability court sitting at Karachi in a corruption case.

An accountability appeal preferred by Mr Shaikh is pending before an appellate bench of the SHC for accountability courts.

The High Court, after perusing the contempt application, in its order said: “On June 19 this court has directed that the appellant be detained in the Central Prison Karachi till the next day, ie, June 20, but the applicant was shifted to Sukkur Prison.” The jail superintendent failed in complying with the order and refused to keep the appellant in custody.’’—APP
