ISLAMABAD, Feb 21: A two-member bench of the Supreme Court on Monday rejected an appeal seeking cancellation of bail of four tenants of military farms.

Justice Muhammad Nawaz Abbasi during the hearing of the application observed that the government should not adopt pick and choose policy in any matter and warned that the practice would destabilize the institutions.

Justice Abbasi also noted that "it is not justified that whenever government wants cancellation of any ones bail, it moves the application and leaves the others". The other member of the bench was Justice Hamid Ali Mirza.

The Deputy Attorney General was presenting arguments on an application moved by the Pakistan Rangers' director-general seeking cancellation of the bail of the military farms' tenants.

On August 28, 2002, an application was lodged with the Saddar police station in Okara alleging that the tenants were attempting to occupy the land of military farms and disrupting the law and order.

About 50-tenants were nominated in the FIR. Later an anti-terrorism court accepted the bail of some of the tenants and the Lahore High Court granted bail to four, including Anwar Javed Dogar.

The government approached the apex court seeking cancellation of the bails of Anwar Javed Dogar, Mr Jabbar and Mr Jameel. However the court rejected the government's application and upheld the LHC and ATC decisions. -PPI
