KARACHI, Sept 14: A division bench of High Court of Sindh, comprising Chief Justice Saiyed Saeed Ashhad and Justice Syed Zawwar Hussain Jaffery , on Tuesday adjourned the hearing of a constitutional petition against the IBA, directing the counsel to satisfy the court on the question of facts.

The bench was seized with the hearing of a petition filed by Asadullah Khan, a student of the institute who challenged the alleged changes/modification of the grading system.

The petitioner making the IBA, its board of governors, controller examinations, vice chancellors of University of Karachi and Jamshoro respondents in the petition sought reversal to old system of grading.

He also challenged the dropping of his name from new semester. Ghulam Qadir Jatoi, counsel for petitioner, appearing before the bench, maintained that changes were made without approval from the board of governors.

When asked to show to the court which rules have been violated and whether he has some proof allegations he levelled against the IBA, the counsel sought time.

The bench adjourned further hearing to a date to be fixed by the office of the court with the following order: "Merely making a statement that illegality has been committed and the order is against the provisions of law would not suffice the petitioner to invoke constitutional jurisdiction of this Court in the absence of some material prima facie establish violation of law". -APP
