PESHAWAR, June 22: A two-member bench of the Peshawar High Court on Tuesday upheld the capital punishment awarded by a trial court to a man for killing a policeman and injuring another.

The bench, comprising Justice Nasirul Mulk and Justice Ijazul Hassan, dismissed the criminal appeal of the convict, Mohammad Islam, and observed that the prosecution had proved its case against the appellant.

The appellant, who is a resident of Jamrud (Khyber Agency), was convicted on Dec 9, 2003, by an additional district and sessions judge. Mohammad Islam had gunned down a constable Karamat Ali and injured another cop Rehmat Khan with his Kalashnikov a few years ago when the policemen stopped him at a checkpoint in the Hayatabad police limits to enquire about his assault rifle.

The injured cop later testified against Mohammad Khan. The appellant was charged under section 302 of the Pakistan Penal Code.
