KARACHI, April 22: Under the current setup, there is no legal existence of a chief executive and a treasurer in the Pakistan Cricket Board (PCB), according to a senior official of the Karachi City Cricket Association.

"There is no constitutional existence of the PCB at the moment because the cricket board is being run by an ad hoc committee for the past four years," Sirajul Islam Bukhari, the KCCA secretary, said in a statement on Thursday.

He said that except the chairman of the ad hoc body, like incumbent Shaharyar M. Khan, who has been constitutionally appointed by the President of Pakistan in his capacity as the PCB Patron, there is no room for either a chief executive or a treasurer on legal grounds.

"According to the PCB constitution, the cricket board comprises the General Body constituted under Article 4, and the Executive Council constituted under Article 25," he pointed out, while adding, "The control, management and supervision of the cricket board vests in the general body which should also approve audited statement of accounts and sanction budget estimates annually."

The KCCA official added that both chief executive and treasurer can only be appointed by the PCB patron under Articles 8 and 9, and by no one else. "The acts and deeds including sanctions made by these two officials are illegal and ultra vires of the PCB constitution."

He appealed to President Pervez Musharraf, the PCB patron, to ask the chairman of the PCB ad hoc committee to take rapid steps for the restoration of the general body and executive council of the cricket board as required under Article 46 (4).
