KARACHI, Dec 12: The Sindh High Court issued arrest warrant of the owner of an illegally constructed building and asked tenants to deposit the rent they owed to their absconding landlord with its nazir.
A division bench of the high court comprising Justices Munib Ahmed Khan and Rana M. Shamim issued a bailable warrant in the sum of Rs50,000 to ensure his presence in court at the next hearing. Despite several notices issued to him earlier, the landlord had failed to appear in court.
A police officer of Jamshed Town was asked to execute the warrant and produce the owner before the bench.
The orders were passed on a petition moved by a non-governmental organisation, Struggle Trust, against the addition of two floors to an old building, located on plots 821 and 822, Block-2, PECHS.
The NGO submitted that two floors had been added to the building constructed in 1972 without any architectural study of the strength of the foundation or the existing floors to support the additional load. The unlawful addition was allegedly made in complicity with the officials concerned of the Karachi Building Control Authority. The builder created third party interest by leasing or letting out all the 12 apartments and eight shops of the building.
Lyari Expressway
Another division bench comprising Justices Yasmin Abbasy and Mahmood Alam Rizvi issued notices to the city government and other respondents in a petition moved by 60 people affected by the construction of the Lyari Expressway.
The petitioners submitted that their properties had been occupied without giving them due amount in compensation. They claimed to be leaseholders of the land taken over by the expressway project. The bench also directed the respondents to maintain status quo till the next date.
