PESHAWAR, Sept 13: Peshawar High Court Chief Justice Tariq Pervez Khan has accepted representation of a district and sessions judge — Shahid Naseem Khan, who is presently serving as the provincial law secretary — and ordered that he be held senior to nine judges whose seniority he had challenged.
It is learnt that a letter has been issued by the high court’s registrar Syed Musaddiq Hussain Gillani to the complainant who had claimed in his representation that he was senior to 12 other officials. The letter states: “I am directed to refer to the subject and to say that the competent authority has been pleased to accept your representation regarding seniority to the extent of placing you senior to Mohammad Bashir Khan, Mohammad Ayub Khan, Mohammad Arshad Khan, Sahibzada Khursheed Ahmad, Subhan Sher, Anwar Hussain, Syed Wajahat Ali Shah, Mohammad Tariq Wali and Mohammad Azeem Khan, all district and sessions judges, subject to withdrawal of your appeal No 12 of 2003, pending before subordinate judicial session tribunal.
“The reason being that at the time of promotion of these junior officers you were not superseded, rather your case has been deferred for want of PER (personal evaluation report) for the year 2004.
“However, your request as against Azhar Khan Naseem, Mohammad Ibrahim Khan and Shamsher Ali Khan is not accepted as they were senior to you at the time of their promotion,” the letter added.
