Prosecution gets last chance for arguments in Hassaan’s case

LAHORE: A Lahore High Court division bench on Tuesday granted a final opportunity to the prosecution for arguments on a petition challenging the military custody of Barrister Hassaan Niazi, a nephew of PTI founder Imran Khan, and all subsequent proceedings against him before a military court.

The bench comprising Justice Shehram Sarwar Chaudhry and Justice Sardar Akbar Ali heard the petition.

A prosecutor appeared before the bench and sought further time to furnish arguments.

The bench allowed the request, giving a last opportunity to the prosecution for arguments and adjourned the hearing till Nov 2.

The petition filed through senior lawyer Faisal Siddiqi contends that following his arrest in the May 9 case, Niazi was not produced before a civilian court, instead Sarwar Road police handed him over to military custody.

It argues that this handover was unlawful and carried out without any judicial order.

The petition asks the court to declare null and void the commanding officer’s notification dated Aug 17, 2023, authorising Niazi’s custody by the military.

It also urges the court to set aside his transfer to military custody and all subsequent proceedings conducted by the military court.

Niazi was sentenced to a 10-year imprisonment in December 2023 in a case of attacking Jinnah House.
