PESHAWAR: Peshawar High Court on Tuesday rejected plea of Sunni Ittehad Council chief Sahibzada Mohammad Hamid Raza, seeking transit bail in a case wherein he was convicted by an anti-terrorism court in Faisalabad and subsequently disqualified as MNA by Election Commission of Pakistan (ECP).

A bench consisting of Justice Syed Arshad Ali and Justice Mohammad Faheem Wali observed that PHC had earlier granted the petitioner transit bail, but he didn’t surrender before the relevant court.

The bench observed that it never declined bail to a petitioner, if he was entitled to it, but in case of transit bail he had to surrender to the relevant court after getting bail from PHC.

The bench also granted protective bail to recently-elected senator and leader of PTI Khurram Zeeshan till Nov 27 and directed law enforcement agencies not to arrest him in any of the cases registered against him till then.

The bench directed federal interior ministry, National Accountability Bureau and provincial government to provide details of cases to the petitioner wherein he was charged. Petitioner’s counsel Alam Khan Adenzai stated that his client was elected senator on Oct 30.

He said that the petitioner apprehended that there might have been multiple cases registered against him in Islamabad and other provinces, about which he had no information.

Meanwhile, another bench consisting of Justice Sahibzada Asadullah and Justice Inamullah Khan extended protective bail to former leader of opposition Omer Ayub Khan till Nov 11, directing LEAs not to arrest him till then.

Advocate Alam Khan Adenzai, appearing for Mr Ayub, stated that the court had earlier granted his client protective bail till Nov 4 and had also sought details about cases against him. He said that so far Anti-Corruption Establishment (ACE) had not submitted it report.

The bench decided to extend his bail with the direction to ACE to submit details if any case was registered against Mr Ayub.
