LAHORE: Leader of the Opposition in the Punjab Assembly Malik Ahmad Khan Bhachar has also approached the Lahore High Court against the new amendments under the Prevention of Electronic Crimes (Amendment) Act 2025.

Mr Bhachar through his lawyer Azhar Siddique filed a petition against the amendments. The petition raises various legal points, saying the amendments to the Peca do not define “fake news,” as any news against the government’s interest could arbitrarily be labelled as fake.

It argues that the sentencing process under the new Peca is contrary to criminal law. The petition also raises the legal objection that the amendments introduce harsh punishments without granting the right to appeal. It says the establishment of the tribunal under the new amendments is in direct conflict with Article 175 of the Constitution, which mandates the separation of the judiciary from the executive and legislative branches of government.

Additionally, it states that forcing journalists to disclose their sources contradicts the rulings of higher courts. Furthermore, the petition asserts that the amendment to the Peca violates fundamental constitutional rights and freedom of expression.

It alleges the purpose behind the impugned amendments is an act of political victimisation and mala fide against the journalists. Therefore, it asks the court to set aside the amendments for being unconstitutional. The high court has already issued notices to the federal government and other authorities on two petitions by journalists against the Peca amendments.
