ISLAMABAD: The Federal Investigation Agency (FIA) has asked the Capital Development Authority (CDA) to deal with the Shifa Hospital encroachment issue in accordance with its own rules and regulation.

An officer of CDA told Dawn that the FIA, through an official letter, referred the case to the civic body a few days ago.

He said the investigating agency had transferred its inquiry to the CDA due to it being a recovery authority dealing with matters of buildings bylaws.

“In the light of the above mentioned recommendations of FIA Zonal Board, M/s Shifa International has violated the bylaws of the Building Control Section (BCS) of CDA, the violations falls under the ICT Zoning Regulations 2020. Hence the matter of M/s Shifa is herby transferred to your [Chairman CDA] good office for imposing the fine/penalty to resolve the matters as per violations committed by Hospital in accordance with Building Control Regulations 2020, with the intimation to this office,” read the FIA’s letter, issued by deputy director corporate crime circle.

The letter dated Dec 7 stated that the said inquiry was started by the FIA in 2016 against the hospital, saying that it had violated the CDA’s bylaws.

It futher stated that the hospital had removed the nonconforming use of college from its premises and vacated the adjacent land earlier encroached on the nullah side.

“The violations of bylaws of the BCS falls under the ICT Zoning Regulations 2020, the fine for without approval of charges are given in schedule-5…there is a provision of change of use charges for basement in Clause 6.7 and additional floor area ratio.. therefore, the same may be dealt in the light of notified rates in bylaws.

The encroached land measuring over eight feet on which hospital building is constructed, a survey has been conducted by directorate concerned of CDA and after determining the original encroached area, the value may be evaluated for making it part of original plot,” the letter said.
