HYDERABAD, Oct 18: The fifth additional district and sessions judge, Hyderabad, asked the SHO Hussainabad police station on Tuesday to register an FIR of Ali Sher if a cognisable offence was made out from his statement which he would record at the police station against ASI Syed Akhlaq Shah, head constable Zahid and three constables.

Syed Javed Bukhari advocate appeared on behalf of the applicant who stated that respondent police officials were posted at the police station and at the night of July 10-11 in the morning they entered the applicant’s house when he opened it.

He said when he objected to their entry in the house they used abusive language and beat him up. He said the respondent policemen trespassed into his house and violated sanctity of chaddar and chardewari.

They conducted searches in the house by opening cupboards and wooden boxes, taking away gold locket of one tola, gold rings, prize bonds of Rs7500, cash Rs5420 and other valuables.

He said after his family members raised hue and cry neighbours, Yaseen, Kashif Shah, Syed Raza Shah, Sikandar, Abbas and other people gathered there.

He said he was thrown into police mobile by respondent and he was taken to Hussainabad police station where he was locked-up.

He said neither any FIR was lodged against him nor was he required in any case by police and that respondent policemen deviated from parameters of their official duty, violating provisions of the Police Order 2002.

His counsel said it was a settled law that police could not enter in a house without permission of occupant or search warrant and respondents had committed offence punishable under relevant sections of the PPC and Hudood laws.
