LAHORE: A compulsorily retired civil judge has asked the president of Pakistan to file a reference against two former judges of the Supreme Court for allegedly passing a “mala fide and corrupt order” on his appeal against the punitive decision of the Lahore High Court.

In a letter addressed to the president, Mian Maqsood Ahmad states that he joined the LHC in 1988 as civil judge and proceeded to the US after a few years where he fell ill. He sought extension in his leave on medical ground but the high court turned down his request.

Ahmad says the high court first proceeded to dismiss him from service, but later on the punishment was commuted to compulsory retirement.

He submits that the Supreme Court on his appeal ordered his reinstatement through a short order. However, the bench comprising then chief justice Iftikhar Muhammad Chaudhry and Justice Khalilur Rehman Ramday, after a gap of five months, decided to rehear the matter instead of issuing a detailed judgment.

The applicant says the bench after rehearing the matter upheld the impugned decision of the high court contrary to its short order.

He pleads that the act of the judges was nothing but a sheer violation of law, willful mala fide, corrupt and an unwarranted order in the eyes of law.

He urges the president to set aside the SC judges’ decision and also sent a reference against them to the Supreme Judicial Council in the best interest of justice.
