PM appreciates ICJ’s decision to not acquit, release Jadhav; says Pakistan will proceed as per law

Prime Minister Imran Khan on Thursday appreciated the International Court of Justice's (ICJ) decision "not to acquit, release and return" Kulbhushan Jadhav — a serving commander of the Indian Navy associated with Indian spy agency Research and Analysis Wing — a day after the court announced its verdict in the case.

In its verdict, the ICJ ruled that Jadhav be allowed consular access immediately and asked Pakistan to ensure “effective review and reconsideration of his conviction and sentences”.
In a post shared on Twitter, Prime Minister Imran said: "Appreciate ICJ’s decision not to acquit, release & return Commander Kulbhushan Jadhav to India."
"He is guilty of crimes against the people of Pakistan. Pakistan shall proceed further as per law," the premier added.
Earlier, Indian Prime Minister Narendra Modi also welcomed the ICJ's verdict.
In a post shared on Twitter, Modi congratulated the ICJ for the verdict, adding: "Truth and justice have prevailed."
"I am sure Kulbhushan Jadhav will get justice," he said.
'Big victory for Pakistan'
Following the verdict, Director General of Inter-Services Public Relations (ISPR) Major General Asif Ghafoor, while speaking to ARY News on Wednesday night, congratulated the nation on "the success achieved" and lauded the efforts made by the legal team and the Foreign Office which represented Pakistan.
"For the verdict to be upheld by an international court where there is no concept of capital punishment is a big victory for Pakistan.
"And for them to say that the review and reconsideration can be done by means of our own choosing is great validation for our judicial system," he said.
"Pakistan will follow the law," he said, reiterating Foreign Minister Shah Mehmood Qureshi's statement on the way forward in the case.
"It's another Feb 27 for India; they have been surprised again. They thought that the kind of political capital they have, they can manipulate justice too but that did not happen," said Maj Gen Ghafoor.
He went on to say that India's "false narratives continue" and that "after this verdict they are practically certified to have undertaken state-sponsored terrorism and the world has seen what their role in Pakistan has been."

Seems there is unwillingness to hang Kulbushan. Probably that he is worth more to Pakistan alive than dead. Pakistan must proceed in the case according to its own laws of the country. The ICJ verdict is not binding but of recommendatory nature. The need of the hour is not to create a precedent which could be used in the future to pressurize any future similar judgments given by our courts.

ICJ cannot acquit or convict on this issue. Whether Pakistan followed due process of law. BBC reports Pakistan broke the international law. Victim cannot now be executed. Consular access has tobe provided. It is not the victory for India but for due process of law.

In its last argument at ICJ India had already withdrawn demand of acquittal of Jaadhav as ICJ could no way have agreed such request. India's case was primarily for counsellor access and stay on execution... Both were agreed by ICJ. Whenever you go to court apart from main remedies you always list out certain wish list which are not tenable but important to make your main request stronger. If Pakistan is considering it their victory then its win win situation. Anyway.. India will pursue is ultimate goal I. E. To bring back Jaadhav.

I congratulate our honerable army, ISI, legal and FO teams for excellent prosecution and defending Pakistan's views in ICJ court relating to Kulboshan's conviction in spying charges. Our case was well presented with evidence and, Indian defence was very weak and they couldn't present any evidence or proof of their fabricated version. The message is very clear to world that India does interferes in other countries sovereignty and incite people against states to destabilise them.

The case was not to prove whether he is guilty or not. It was about whether provisions of Vienna convention r met or not. If not then either acquite him or fully implement article 36-1,2, and 3. It's simple like that.
IK has every right to seek safeguard of his citizens and at the same time he should be cautious about the word "wrongfully", which was quite a few times added to other words to form some questionable phrases which may impact in future arbitrations and further affect Pakistan adversely in other international forums.

What the ICJ is simply staying all the orders by the Pakistani courts but giving him an access to councilor in case if the Pakistani law include a venue for appeal and yet still give Pakistan the authority to follow the law of Pakistan. It has given Pakistan another chance to further embarrass India in an international platform.

Release denied, repatriation denied, aquittal denied, annulment of military court decision denied, ICJ accepts that Pakistan has the right to declare KBJ an Indian spy, same thing for terrorism. The decision made by military court hasn’t been annulled only that Pakistan has to review “by the means of its choosing” after providing consular access.
KBJ will be tried in Pakistan by Pakistani judges and according to Pakistani law. Yet, Indian's are declaring this a win.

@Zak, your interpretation is not surprising, as the way you interpret other resolutions. Read the whole verdict and understand why only the lone ad hoc Pakistani judge has to dissent. This is not a complete victory, but allowing for counselor access and asking to review the death sentence itself an achievement. Now, no more closed meetings and forced tortures. Only Open trial under media watch light.

@Na, Did India keep to the 2008 agreement it signed with Pakistan on consular access. That is the law by which the issues are governed between the two nations on this subject. It is India showing its duplicity on the issue. Gentleman's stand by their agreements but India has proved time and again it is no gentleman and ignores the UN bodies. It is time both India & Pakistan accepted international bodies decisions and acted on them and stopped throwing childish tantrums like a little brat, this does not help ordinary citizens or their families of either country. I do not understand how people in both countries seem to think it is win for them - ask Jahdav or his family if they are in any less pain or worry today.

@Zak, Read properly:The ICJ judgment has ruled in favour of India on all points of contention. It accepted that the case fell within its jurisdiction, that Pakistan has violated the Vienna Convention by denying Jadhav consular access and that allegations of espionage or any bilateral India-Pakistan agreement on consular access do not exclude such access. Further, that Jadhav was not informed of his rights, that India was not informed of his arrest, that India has not breached any of its international obligations .

Problem in India is that most people use the rating obsessed media for information. The ICJs decision is a 42 page document. Its in English and legal jargon can be Googled. I invite the Indian people to read the document over the weekend.
IMO, ICC has taken a middle ground and the verdict is not in favor of one versus the other.

Everytime India goes to a third party, India loses, like Kashmir UN resolution, Indus water treaty, February 27th India got US involved who confirmed India did not shoot any F 16, all were intact and now the ICJ, denial of Indian plea in court.
That is why India evades UN involvement in Kashmir, knowing they will lose.

Show everyone indisputable proof that he is a spy. The onus of proving wrongdoing is on the accuser.
But there is no wrong doing here on part of Jadhav. He's just a ordinary guy, not a spy

That is not the conclusion that ICJ cane with. They said that by denying him consular rights and legal representation of his choice his right to a fair trial was compromised.

@desi dimag, OK, so what now? He is still going to be tried (and hanged) under the present law of Pakistan, per the ICJ ruling and which was welcome by everyone in India. So lets do it. Everybody seems to be happy with this outcome, as it appears.

@Rajput, ICJ never ruled that he should tried under civil laws of Pakistan (Instead the current law of Pakistan which includes the military court as well). Read the verdict first before making a comment. It seems like there are over a billion self thumping buffoons incapable of understanding the outcome of the verdict.

@Ash, Don't worry what India will do during the trial - that comes later. First Pakistan will provide consular access to Jhadav where the whole truth of his abduction from Iran will come out. Pakistan will also have to present all the evidence they have collected which will be examined and verifed by India and the rest of India's allies.

@Mohan , we are not bound by ICJ and the world would be watching Indian interference in Pakistan. We would take the decision according to the law of the land. We have enough evidence and that’s why ICJ rejected Indian demand of release return acquittal of Jadhav. Well done Pakistan team for winning the case
