HYDERABAD, Aug 25: The Sindh High Court, Hyderabad circuit bench, on Monday directed the SHO, Jamshoro police station, to lodge an FIR of the petitioner against the ASI of the police station, if a cognizable offence was made out.

The court, however, also directed that if the petitioner remained unsatisfied then he could also file a written complaint against the ASI in the relevant court of law.

The order was passed by Justice Azizullah Memon on a constitutional petition of More Khan who sought registration of an FIR against the ASI, Jamshoro police station, Nawab Khan Rind.

He said that on June 3, following a scuffle of his son, Mohammad Nawaz, with Mohammad Yousuf and another accused, a case was lodged against them at the Jamshoro police station.

However, he said, the respondent, ASI Nawab Khan Rind, supported the accused and put pressure on the petitioner’s son to withdraw the case.

He said that he trespassed into his house, picked up Ali Murad and detained him at a private place where he was severely tortured, causing injuries to him.

He said that on July 28 his son was released after threats of dire consequences.

He said that when his son returned from his village, the ASI registered a false case under section 5-A of the Gambling Act against his sons, Mohammad Nawaz, Ali Murad, Liaquat and others, and added that on July 31 the ASI picked up his son, Mohammad Nawaz, and confined him to a private place, subjecting him to torture.

After hearing both the sides, the court, however, ordered that the petitioner should approach the police and his FIR would be lodged if a cognizable offence was made out.

It allowed the petitioner to file a direct complaint if he remained unsatisfied with the police.
