PESHAWAR, Aug 12: The Peshawar High Court on Monday accepted petition of an alleged drug smuggler and granted him bail.
A single bench comprising Justice Dost Mohammad Khan directed that the petitioner should be released after furnishing two sureties of Rs200,000 each.
The applicant, Wilayat Khan, resident of University Town, was arrested on June 4 by the Railway police when he visited the Cantt railway station to inquire about some luggage booked by his brother. The Railway police had recovered 44kgs of charas from the said luggage.
Advocate Noor Alam appeared for the petitioner and argued that the luggage was not booked by the applicant nor did he possess the key to the box or the booking receipt which proved his innocence.
The court observed that unless there was a strong presumption of the involvement of the petitioner with his brother, he could not be denied the right of bail.
