KARACHI, Aug 7: A division bench of the High Court of Sindh comprising Justice Sarmad Jalal Osmany and Justice Rehmat Hussain Jafferi dismissed an appeal filed by a police officer for faulty investigation.

The bench was hearing an appeal filed by convict Khair Muhammed Chandio.

The appellant, posted in Federal B Industrial Area, investigated the murder of traffic police constable Abdul Salam, who was killed by unidentified men on Jan 21, 2000.

The appellant arrested Murtaza Sajjad alias Shah Rukh and challaned him before the court.

The administrative judge of the anti-terrorism courts took strong exception to it as the appellant delayed the submission of challan. At trial he moved an application under section 265-K of CrPC seeking acquittal of the accused on ground of insufficient evidence. The SPP appearing before the trial court also pointed out faulty investigation carried out by the appellant.

The trial court issued notice to him on charge of faulty investigation and contempt of court. He was also sentenced to serve imprisonment for 15 days and to pay a fine of Rs10,000 under section 37 of the Anti-Terrorism Act (ATA 1997).

Sindh AAG Habib Ahmad during the hearing of the appeal supported the judgment by the trial court.
