The Islamabad High Court (IHC) on Monday decided to hear the petition filed by Uzma, an Indian national who went missing from the Indian High Commission earlier this month, along with that filed by her Pakistani husband, Tahir Ali.
Speaking to media after Monday's hearing, the lawyer representing Ali said his client rejects all allegations levelled against him by Uzma. He added that his client had requested the court to allow him to meet his wife.
However, Malik Shahnawaz, the attorney representing Uzma before the IHC, told reporters that the question of Ali meeting his client does not arise, since the marriage contract between the two was signed by his client at gun-point and therefore, is not accepted to be legitimate.
Last week, Uzma appeared before a lower court and stated that she was forced to marry her Pakistani husband at gunpoint and was subjected to abuse by him.
The twenty-year-old Indian national met Ali, a resident of Khyber Pakhtunkhwa, while the latter was working as a taxi driver in Malaysia eight months ago. The two were married in early May. A few days after their marriage, they had approached the Indian High Commission — reportedly to secure Indian visas — after which Uzma had 'gone missing' allegedly from the commission's premises.

the problem is the women does not want to stay with the man .she is not happy she has a right to clear off . the good pakistani courts take too long in cases . why she should stay till the end of the case . allow her to go her lawyer will represent her .

i'm sorry but she has signed a marriage contract, she can't just pull out in few days of their marriage, she is still Ali's wife and only he can release her if he want's, otherwise this case can drag on for years on end.

there is should be an opportunity for companies to sponsor these cases through paying the clients' lawyers fee, as they are always a good source of publicity in the media

Some very strange statements by Ms Uzma. Surely, she wasn't a child? She met this man in neutral surroundings in Malaysia and she felt confident enough to join him in Pakistan later, despite his tribal background? How was he able to force her to marry at gunpoint? Was she not already willing to marry and did she not come to Pakistan expressly for that reason? There seems to be some sort of gap or vacumn herein. It seems more likely that she married and only later found out her husband already had a wife and kids, compelling her to make up this whole 'abuse' story to get out of this marriage. I hope this sad mystery is resolved soon.

In any case, whatever the reason, she does not want to live with this man and wants to return to her home country. Why should she be prevented from doijg so?

Regardless of marriage under gunpoint, if the wife wants to leave now, she should have the freedom to do it. She cannot be treated as a slave.

Is there anyway any one cam force her to stay with her husband against her will.
Non.no law can do that

Can the man prove that it was not under duress? The wedding photographs may not show the entire picture. A gun that is 20 ft. away may not show up in pictures, but could still instill fear in her heart.
Besides... if she does not want to stay with him, for whatever reasons, why are people wanting to force her to do so?

Your definition sounds a lot like slavery to me, where the ill-treated wife has no glimmer of hope and rescue.

@MIRROR CHECK - my dear i am merely pointing out the the facts, of what goes on in Pakistan, not Essex. I know this all seems a bit hard/harsh to you but it's the fact. Have you ever been to courts in Pakistan? simple land cases or property case can last up to 2 or 3 decades. good luck to the poor Indian lady: but i must say her story doen't add up.

it is simple - she does not want to stay with this guy - FULL STOP - she must be given reprieve and let go to wherever she wants - gun point or not gun point - she has decided not to live with this guy - nothing more is important
let her go to her home - back to india and live peacefully
she should not have raised wrong allegations that he forced it on her - - where in Video (Publicly available) - she is seen in Nikkah Ceremony - apparently with any duress and happily getting married

@Muhammad ASIm Rao : Yes agreed IHC immediately give her exit permit without any delay and let her go back to her home in India her daughter are not feeling well. This simple, Guy is simple driver, have wife+4 children unable to keep one wife and went to drive in Malaysia not for marriage. Let court given Uzma permit. I am woman and understand her feeling.

Love turns to bitterness when blatant deception and lies like an undisclosed previous marriage with four children comes to the front. Also, one needs to complement Uzma's presence of mind to string along the "husband", being in his good books and smartly suggesting a vacation or vocation in India. And then using her nation's protection to get out of this sham wedding.

She could have just said that she does not want to stay with this man, that she made a mistake and ask to annul the marriage. That would be easy to handle. If she is accusing him of forcing her at gun point, it is a serious business - a grave crime-and the issue needs to be dug to the bottom. She just cannot be let walk away given the circumstances. The book should be thrown in full at the guy if he did that. Otherwise, she has some answer to make.
