ATC sends Qadir Gilani's guard on 14-day judicial remand

LAHORE: An anti-terrorism court (ATC) on Friday sent Mohammad Khan, the security guard of Abdul Qadir Gilani, on a 14-day judicial remand for allegedly killing a youth.

ATC Judge Rai Ayub Khan heard the case today pertaining to the shooting of 23-year-old Malik Tahir, which involves the son of former PM Yousaf Raza Gillani's along with six guards.

During the hearing, police requested the court to send the suspect on a 10-day judicial remand, following which the court sent him on a two-week judicial remand. Arrangements for the identification parade of the suspect wiill be made in the jail, police added.

Tahir was killed after a guard fired on him following a quarrel near PTCL Exchange on Mian Ghazi Road, Defence, on Wednesday evening.

The guard had stated before the police that the motorcyclists were repeatedly overtaking squad vehicles of Qadir Gilani which irritated the guards and he opened fire with an intention to shoot the victim in his foot.

The victim’s family has urged the police to arrest Abdul Qadir Gilani. Police investigators had been reluctant to detain Qadir Gilani but included him in the course of the investigation keeping in view the sensitivity of the case.

“My primary demand to the Punjab government and police authorities is to arrest Qadir Gilani who was travelling along with his security guards at the time of shooting and escaped instantly from the crime scene. The shooting took place at [Gilani’s] behest,” Malik Tanveer, the father of victim Tahir had said.

The guard is allegedly responsible for shooting unarmed youth Tahir Malik. If the guard testifies that Mr Abdul Qadir Gilani ordered the shooting or shot the youth only then can he be charged. This does not appear to be the case. Good that the PTI and PAT jalsa's are providing quicker justice. The judges should fear public outrage against judges who do not do their duty for the people and for God. Pakistanis should know that once a judge is appointed he or she cannot be removed except by the most senior judges. This makes it easier for many to become corrupt, and provide rough justice, where innocents are jailed and the guilty rich rule the country.

So according to guard, the poor boy was murdered because he was irritating the guards. I say shot him too, he has irritated the whole nation. I agree with victim's father, Qadir Gilani should be arrested and put to trial as well.

The victim's family is absolutely wrong. Don't they know he is a son of Gilani ? Don't they know a VIP like him can shoot any innocent passer-by anytime ? Don't they know our police and courts are there only for the safety of these honorable VIPs and they have nothing to do with common man ? Don't they know we have two different laws, one for VIPs and one for a common man ? They should know we are not living in Khulfa-e-Rashidin time. We live in a pure democratic country where rulers, their families and their relatives are never accountable for anything b/c they don't do anything wrong.

Without the instructions of their owner (Abdul Qadir Gillani), guards cannot fire. The had lot of options to tackle the situation. They all must be punished equally. No VIP tretment should be allow with son of ex premier.

What training does these guards have? How did he try to justify his intentions to shoot the victim on feet because the guard became irritated? What steps police has taken to look into training of rest of guards involved in this incident? What if they also get irritated due to some similar incident in future. I expect no justice in this case. There is not even a single example that can help us to hope for justice. Even during days of judicial activism besides every effort former chief justice was unable to set any example besides taking many suo moto actions. The worst for elites is to give compensation money at end to victim's family and get free.

I daily drive on Shahrah-e-Faisal, and I can assure you, whenever you are driving behind or in front of Police Mobile, they just give you Gesture to avoid driving behind or front of there vehicle, seems like they have purchased the road and nobody should drive in the lane they are driving. Its because of our Police and Forces has some stupid sense that everybody gonna hit them, or they just want to show how powerful they are.

Qadir Gilani and that guard should be hanged on the same street and the same place where this incident happened....Looks like Pakistan is moving towards the mob justice...Mob justice is the only solution of this VIP culture......Like people do in Karachi with mobile snatchers...they catch them and burn them.......I know lot of people will try to bring a Newton or Einstein new theory but put oneself on that boy's father and mother place........Shame on people of Lahore who witness this incident but didn't retaliate...Today this happen with this boy tomorrow it can be your brother, your son...so wake up....

Was the guard instructed by Qadir to shoot? And why he shot just because the victim was trying to overtake? In Pakistan this is very normal driving method. Qadir must be arrested and questioned for his role. In Pakistan we have hanged people who were not even on the scene, Qadir was too close for comfort. And then they left the scene which is a crime in itself.

@Mohammed Kiani, It is not the duty of the judges to charge a person. The prosecution charges and judge hears the evidence. Judges cannot decide based on the public emotions but evidence. So please separate the two.

In Canada there is a severe punishment for running\driving away from a crime scene.. harsher if your are involved. Gillani Jr. should atleast be charged for failure to stop at a crime scene ..

This has not happened for the first time. Innocent people have been frequently brutally beaten by guards of ruling elite for violating the sanctity of their masters by daring to overtake them. Defence Karachi is a common sight for such incidents where sons and daughters of Sindhi ministers and bureaucrats regularly visit shopping malls with scores of armed guards and no civilized person can dare to question them for their behavior. Shahzaib Jatoi and one recent killing at the hands of a police officer's son are still fresh in memories. I, remember, Sharmila Farooqi's guards also gave brutal beating to one rider near Khayaban-e-Ittehad few years back when he tried to overtake her Land cruiser. He was lucky that he did not get bullet for it. This has become a part of the culture of our ruling class and is going to stay here till we continue to protect rotten system in the name of democracy.

Sweet Heart: People didn't decide, its law everywhere in the world that someone who is acting on someone's behalf is considered an AGENT of that person, and in this case Qadir Gilani. The Guard had no independent personality and he was there to travel with and protect Qadir Gilani. And even from your way of thinking, if Gilani is not responsible for the murder then what were the terms of guard's employment? If the term was that he would make a judgement call to shoot someone down then he is directly guilty, and if the term was that he would seek the permission of Gilani then he is guilty of criminal negligence but Gilani cannot be held clean from this mess@Salman
