Case against nine-month-old quashed

LAHORE: The lawyer of nine-month-old baby Mohammad Musa charged with attempted murder withdrew the plea for bail on Saturday after police struck off the baby's name from the first information report (FIR), DawnNews reported.
Following expiry of the bail period, Musa was brought to a sessions court in Lahore for the case's hearing during which a police inspector informed the family that the baby's name was not registered with the police anymore.
Meanwhile, the court issued a show-cause notice to a policeman over what it called dereliction of duty.
Whereas, the policeman alleged that the baby brought in the court was not Musa.
Meanwhile, Musa’s family and their lawyers said the police was troubling them using various excuses.
“Police told the court that the nomination of Musa in the case of attacking police and gas company officials was a human error and Musa is not required,” defense lawyer Irfan Sadiq told Reuters.
On Feb 1, the case was registered against members of a family (including baby Musa) and dozens of other inhabitants of Muslim Town after they allegedly attacked a bailiff and a raiding team of the Sui Northern Gas Pipelines (SNGPL) after it went there to arrest people involved in gas theft.
The baby's grandfather, Muhammad Yasin, and his three sons still face the charges.
The judge had earlier granted confirmed bail to Musa against bail bonds worth Rs50,000, but he had to appear before the court today.

What kind of world our we living in, in which a nine month old baby boy is being charged with attempted murder. Even though the police withdrew his name from FIR, but still what kind of investigation was conducted by the police to include his name. The police officer who had included the name should be immediately suspended and case should be lodged against him.

First, there is not law under which this kid could have been charged. But he was charged anyway. This means his charging, booking and keeping in custody was all illegal. Kid was bailed later, this means he was under arrested illegally, kept in detention illegally and he did not need a bail.

Shall we abolish the penal code laws related to attempted murder, because it has been misused even by the police??
Had it been a blasphemy case, there would have been lot of hue and cry.
If there is a procedural problem or implementation problem with a law, the exact problem must be address. The argument of repealing of the law itself may be crazy one.

No it should not come that easy. This infant's life is ruined to the extent that he was charged on false case, at the age of 9 month he was taken to a police station & he had to put his thump impression to get bail. When he grow up how will he react. Filing of FIR is no small thing. The CJ should take notice. Had this heart breaking event took place in any civilized country millions would have to be paid by the police depart to quash this case.

Baby Musa and his family can win big money if they sue these clowns in the Police force.
It is most likely sloppy work by the police and it may just be possible that some one intentionally gave the wrong name and fathers name and the police did not bother to check ID card or other ID. What ever happened it was on CNN and so by now its a big story and so Baby Musa will be smiling all the way to the Bank.

It is not only that illiterate policeman. The whole line up of law enforcement people. What about head of police station called SHO. How about the prosecutor. How about the judge who asked that boy be brought back again and then finally what about the guy taking thumb impression of a crying child. None of them had guts to stand up and say there has been a mistake.

I fail to understand the competence of the SSP and IG. They are responsible and accountable for the actions of their juniors. They have failed to do their job and must suffer consequences of causing public going through this nuisance. The entire world is laughing at Pakistani policing system and how come these officers themselves could not amend the FIR or quash it.
No Pakistani is questioning this......a confused nation in chaos

In Pakistan as we know the FIR makes the foundation of a criminal case, later on used by the lawyers to help criminal evade punishment. At times some corrupt police official mislead the person who lodges FIR and irrelevant persons are nominated so as to give benefit to the real culprit.

If you want to escape the police dragnet in Pakistan you have to be a really big crook. Say, a President with multi-million dollar corruption charges pending against you; or an alien mafia don operating from Karachi while the intelligence services fein ignorance about your very existence; or you can sit in London and order political killings. A none-month old baby? Well what has he earned by the way of privileged existence?

Good, Can the family now please pay its utility bills which led to this laughter lot. Media has gone crazy because of ratings and sweeping the real issue under the carpet. In my opinion the family is equally responsible for this anguish caused to the child as the police constable is.

I am certain there is some game here also. PK police by and large is corrupt and under trained. in this particular case people in many cities are stealing gas and electricity or not paying bills. Because of this rest of the country is suffering. It is clear when police with gas officials went to collect bills they were abused and stoned. Is that act of any civilized society? Police then reacted and in rush took all family members names and booked the case not realizing one of them is the baby.
