KARACHI: Prosecutor issued notice in Afaq case


KARACHI, April 9: Judicial Magistrate, East, Pervez-ul-Qadir Memon on Friday issued notice to district public prosecutor for Saturday in a contempt of court application filed by Shamsher Ahmed Khan advocate , counsel and chairman of MQM-H legal aid committee.

The applicant maintained that on April 7 when the accused Afaq Ahmed was produced before the court by police for obtaining physical remand, the court allowed daily meeting of counsel with his client.

Shamsher Khan advocate maintained that he went to the CIA Centre, Saddar, where the accused was detained and presented orders of the court regarding meeting of the accused with his counsel. He said that DSP Investigation Qazi Chand refused to allow such a meeting stating that the orders of the magistrate were not binding and if he (counsel) wanted to meet Afaq Ahmed he should seek permission from interior ministry.

The Judicial Magistrate after hearing initial arguments issued notice to the state for Saturday. In a related development, Additional District and Sessions Judge (South) Syed Saeed Hasan, on Friday, dismissed a habeas corpus application filed by Akhlaq Jehan, mother of Afaq Ahmed.

The applicant, who filed the petition on Thursday, expressed apprehension of danger to the life of Afaq Ahmed due to non- availability of proper medical treatment.

The accused is stated to be suffering from heart problem and related ailments. When the matter was taken up by the ADJ South on Friday, nobody was present for the petitioner at which the court dismissed the application for non-prosecution. -APP
