FTO directive to CBR

ISLAMABAD, Oct 21: Federal Tax Ombudsman Justice Saleem Akhtar has asked the Central Board of Revenue to cancel the proceedings initiated for assessment of an assessee under the normal law.

The Ombudsman observed that the proceeding initiated by the respondent was contrary to the law, said an official announcement issued on Monday.

He also said the compliance report should be produced within 30 days of receipts of this decision. The assessing officer not only issued successive notices without reasonable cause and kept the matter pending for almost two years, which established negligence delay and ineptitude in performance of official duty, said the Ombudsman. He said that any assessment made in pursuance thereof be amended under section 122 of the Income Tax Ordinance 2001, so as to restore the original assessment.

The complainant, Aman Ullah, c/o Ahmad Musheer & Co of Lahore, filed their returns, which they said qualified for acceptance under self-assessment scheme (SES) because of higher turnover, higher declared income and higher tax due/deposited that the required percentage as per the scheme.
