Company told to file petition afresh after files stolen
ISLAMABAD: A petitioner company, which had approached the Supreme Court for an urgent hearing on a corporate dispute, finds itself in a novel situation after a robber stole all the files related to the case.
An informed source told Dawn that the petitioner Green Tree Holdings Limited (GTH), which had filed the petition before the Supreme Court in June last had been informed by the court office on July 14 to file its petition afresh along with three paper books in each case immediately to avoid any inconvenience to the court since the case files have been stolen.
The reason cited for filing the petitions by the court office suggested that while transferring the case to the Principal Seat of the Supreme Court at Islamabad through a courier service, the vehicle carrying the case files had been robbed and the subject petitions have also been stolen.
The case was expected to be resumed within this week, said a senior counsel on condition of anonymity.

During the last hearing on June 25, a two-judge bench consisting of Justice Shahid Bilal Hassan and Justice Aamer Farooq while granting status quo had ordered to issue notices for a date after two weeks with a direction to the parties to file concise statements.
The Supreme Court, had taken up a challenge to the June 20, 2025 Sindh High Court judgement, in which the high court had allowed with certain observations the application of Muhammad Ziaullah Khan Chisti filed under the company laws.
The SHC had ordered that the shares held by the GTH in TRG Pakistan (respondent) were the property of TRGP which will deem to have been purchased by TRGP from its shareholders.
The high court had also ordered that the Board of Directors of TRGP will issue notice for calling an extra ordinary general meeting of the company immediately for electing directors and after elections, the new board of directors will decide whether to retain or cancel these treasury shares.
During the last hearing at the Supreme Court senior counsel Ahsan Bhoon while representing the GTH had argued that while deciding the petition, the high court had granted relief which was not requested or prayed and direction was made to hold the elections of the Board of Directors forthwith and petitioner has been divested of its shareholding as well.
On the other hand, the counsel representing the respondents (Muhammad Chisti) had submitted that elections were to be held in any case in Jan. In response the petitioners had pleaded that parties involved in the matter were pending all over Pakistan even before the Islamabad High Court (IHC).
The case has to be resumed this week but until now no date for fixation of the case has been announced.
