KARACHI, April 7: The police are ready to get quashed an FIR lodged by a woman against a grandson of an influential Pir of Sindh for killing her pregnant daughter.
Nadia Khan lodged FIR 74/2003 at Darakhshan police station against Syed Ismail Shah and his driver Abdul for killing her daughter Tania, aged 20. Clifton town police officer Munir Shaikh, however, said Nadia had also submitted an application seeking withdrawal of the case.
A duty officer at Darakhshan police station, Asghar, claimed that a compromise had been reached between the complainant and Ismail Shah after which the former had filed an application seeking withdrawal of the case.
Earlier, Nadia told the police that Ismail Shah, son of Yunus Shah, married Tania some three months back in Multan and brought her to Karachi. He kept her at an apartment in Badar Commercial area in Darakhshan police limits. Ismail Shah, along with his driver Abdul, took Tania to a private hospital, when her condition deteriorated as she was pregnant.
After doctors at the hospital declared Tania dead, Ismail and Abdul disappeared leaving her body at the hospital. Tania’s aunt Zaibunnisa was informed of her death. She informed the police, and also Tania’s mother in Multan who came over to Karachi the next day.
Initially, Nadia also alleged that her daughter was given wrong treatment at the private hospital, situated in a posh locality of Clifton and owned by a provincial minister. The hospital management, however, told the police that Tania was dead on arrival at the hospital.
Tania’s body was brought to Jinnah Postgraduate Medical Centre around 5:30 in the morning of April 4 for postmortem examination. Woman medicolegal officer Dr Sumaiyya at the written request of the SHO Clifton performed post-mortem on Tania’s body and reserved the cause of death till the receipt of reports of histopathological examination and chemical test.
Nadia had earlier alleged that neglect by Ismail Shah caused his daughter’s death.
Tania’s husband, with the help of the police, tried to convince Nadia for out-of-court settlement of the matter and offered her a handsome compensation, the police sources said.
After two days of negotiations, Nadia decided to accept the compromise offer. Later, she submitted an application asking for withdrawal of the FIR, saying she was not in a position to pursue the case.
From the beginning of the case the police avoided the press and the SHOs of Boat Basin, Clifton and Darakhshan declined to divulge the details of the case. Police officers at every level remained tight-lipped on the matter allegedly due to political pressure.
The police had been confused where the case should be registered. The Darakhshan police maintained that Badar Commercial area fell in their jurisdiction, but since Tania died in a hospital that was in the jurisdiction of the Boat Basin police, the case should be registered at Boat Basin police station. The Boat Basin police contended that Tania died in her house at Badar Commercial area, so the case should be registered at Darakhshan police station.
The legal proceedings in connection with disposing of the body under section 174 of CrPC was carried out by officials of Clifton police station and the SHO Clifton asked in a written request the medicolegal officer of the JPMC to perform post-mortem on Tania’s body and inform him of the cause of death.
Later, the police decided to register FIR 74/2003 at Darakhshan police station.
The postmortem report was still awaited which would disclose the cause of Tania’s death, whether she was given medicines at the private hospital and her time of death as well, the sources said, adding now the report might not be released.
