PESHAWAR, April 1: The Peshawar High Court accepted here on Tuesday an application of a former chief engineer of communication and works department, Mr Sanaullah Babar, and transferred his case to another accountability court.

A single bench, comprising PHC Chief Justice, Justice Mian Shakirullah Jan, directed that the trial against the applicant should be transferred to the accountability court No. 3, presided over by Syed Yahya Zahid Gillani.

Earlier, the trial against the accused was conducted by the accountability court No. 1, but as the court has been without its presiding officer since December last, his case continued to linger without any progress.

The then presiding officer, Mr Said Maroof Khan, had completed his three-year contract, following which his services were not extended by the prime minister.

Similarly, the accountability court No. 2 is also without a presiding officer since the completion of the term of the then presiding officer, Mr Attaullah Khan.

Advocate Zafar Abbas Zaidi appeared for the applicant and argued that the trial in the reference filed against the applicant by the National Accountability Bureau (NAB) could not be concluded due to non-appointment of the judge.

He argued that the applicant had been suffering and facing delay in completion of his case for no fault of his.

The NAB has charged the applicant of possessing assets to the tune of Rs77.5 million, which are not in accordance with his known sources of income. Mr Babar was arrested in January 2002.

BAIL REJECTED: A local court here on Tuesday rejected bail application of a person accused of being involved in the abduction of a minor Afghan girl.

The court of additional district and sessions judge Saleem Khan observed that the accused-applicant was not entitled to bail.

The applicant, Haji Amir Mohammad, was charged of helping his nephew, Mr Ghani Khan, in taking away an Afghan girl to Afghanistan. The FIR of the case was registered on March 7, 2002, at Nasir Bagh police station.

Advocate Saleem Khan appeared for the applicant and stated that the applicant was step uncle of the prime accused and he was not responsible for the acts of his nephew.

He added that in the FIR, complainant Saifur Rehman had claimed that his daughter had gone with their neighbour to Afghanistan at her free will.

Later on, he claimed, the complainant changed his statement and implicated the applicant in the case so as to blackmail him and get money from him.

PHCBA: The annual elections of the Peshawar High Court Bar Association will be held on April 26.

According to the schedule issued by the election commissioner, Akhtar Ali Khan Nahki, the last date for filing of nomination papers would be April 10, whereas scrutiny of papers would take place on April 12.

Candidates could withdraw nomination papers on April 15 following which final list of contestants would be issued on April 16.

Under the election rules only those members would be eligible to cast vote who clear their dues till April 9.

The other members of the election commission are Mohammad Amin Khattak, Sadullah Khan Marwat, Ali Jamil Qazi and S. Naz Mohammadzai.

Presently, Advocate Asadullah Chamkani is the president of the association. He belongs to Malgaray Wakeelan, affiliated with Awami National Party.
