Housing scheme case disposed of

HYDERABAD, March 21: The Sindh High Court on Friday disposed of a constitutional petition after the director of the building control department said that action had been initiated against persons responsible for raising unauthorised construction.

The director, Building Control Department, Masood Ahmed Jumani, said that a notice had been issued to the respondent and after the expiry of the notice period, officials would take further action by demolishing the illegal construction.

A petitioner had stated that in addition to this construction — the Farid Illahi Housing scheme — other construction was also occurring on various plots.

The court had asked him to point out details in this regard in writing to the respondent, Hyderabad Development Authority, enabling them to take action according to law.

The matter was first filed before the court in 1999 by Nadir Hassan, who had contended that the construction of the Farid Illahi Housing scheme was being carried out by Haji Gulshan Illahi on an area of 32 acres in Gujo deh, Hyderabad city taluka.

Different orders were passed by the court, the petition was earlier disposed of on May 3, 2000 along with other listed applications.

MURDER CASE: The Sindh High Court on Friday rejected a bail application in murder case of a Pesh Imam.

The application was filed on behalf of Mashooq Khoso, seeking bail for the applicant on the ground that he was a minor at the time of the offence.

Mashooq was booked in a murder case with Hidayatullah by Ramzan Khoso, father of the deceased Khan Khoso.

The case was registered at the Qazi Ahmed police station after Mr Khan was shot dead by Mashooq in front of the mosque.

The defence counsel argued that the applicant deserved bail in the light of provision of Juvenile Justice System Ordinance 2000 on grounds of age, adding that the applicant had been below 18 years of age at the time of the offence.

The state counsel had opposed the bail application, saying that bail could not be granted on these grounds as other circumstances should also to be considered.
