Plea against Wapda adjourned

LAHORE, Dec 17: The Lahore High Court adjourned for Jan 30 the proceedings on a petition filed by a foreign construction company against Wapda.

Hyndai/Hitco pleaded that it had entered into an agreement with Wapda during 1994 for carrying out construction work on Chashma Hydro Power Project.

According to the petitioner, Wapda paid it Rs5.5 million under the agreement for the work done but later demanded the amount back, saying it had not completed the work according to the conditions agreed.

It has been argued that the payment had been made to Hyndai after a resident engineer of Wapda had confirmed the completion of work. Under the agreement, any payments made by Wapda could not be revoked.

Wapda’s counsel sought at least one month’s time. He submitted that he would furnish a written reply to the petition on the next hearing after seeking instructions from the Wapda authorities.

Allowing the plea, Justice Saeed Akhtar adjourned the proceedings.

ECL: Justice Ejaz Ahmad Chaudhry issued notice to deputy attorney-general for Dec 27 on a petition filed by the general manager of the Karachi Port Trust, seeking deletion of his name from the Exit Control List (ECL).

Petitioner Farooq Ahmad submitted that he was planning to leave for Haj next month but his name had been put on the ECL, impeding his departure to Saudi Arabia.

He requested the court to direct the authorities concerned to delete his name from the ECL. He argued that since he was leaving the country for a noble cause and could confirm his registration in Saudi Arabia in this regard, the government had no legal or moral grounds to stop him from going to the holy land.

Justice Ejaz Chaudhry observed that petitioner’s intentions had to be respected but he would like the deputy attorney-general to update him in this regard after seeking instructions from the authorities concerned.
