LAHORE, Dec 9: A division bench of the Lahore High Court directed the Punjab Additional Advocate-General on Monday to contact Lahore Corps Commander for the service of summons on the Defence Housing Authority secretary.

The SP Cantt has also been directed to serve the notice on DHA secretary Col Jaffer who had allegedly refused to appear before the court.

The Additional Advocate-General and SP Cantt would update the bench on Dec 12 regarding the service of court summons.

The bench observed that the Lahore Corps Commander should ask the accused to appear before the court and act in accordance with law.

Previously, Amjad Ikram had submitted in a petition before a single bench that Col Jaffer had sealed a private school in the Lahore DHA in violation of a stay order granted in 1995 and had deputed his staff there to stop its functioning.

The accused had not only refused to attend the court but threatened the bailiff when he raided the school for its vacation. Following the submission of bailiff’s report, the chief justice of the Lahore High Court constituted a larger bench to hear the petition.

The counsel for the accused submitted that an appeal had been filed before the Supreme Court against the status quo issued in 1995 and these orders had been vacated.

The bench observed that no stay orders had been received by it as yet and the accused should appear before the court.

PLEA DISMISSED: A full bench of the Lahore High Court rejected on Monday a plea seeking the disqualification of PML-J leader Hamid Nasir Chatta from being elected as a legislature.

Petitioner Malik Abdul Rahman had pleaded that Hamid Nasir Chatta did not fulfil the requirements of Article 62 and 63 of the Constitution and should be declared disqualified from being a member of the legislature.

Justices Javed Butar, Ejaz Chaudhry and Jamshed Ali Shah observed that petitioner had failed to establish his plea and no concrete proof could be produced in this regard.

The bench further observed that earlier an election tribunal had also rejected the same plea and therefore the petitioner had no grounds for appeal.
