LAHORE, Nov 16: Convicts guilty of attempt to commit an offence under the Hudood ordinance are entitled to remissions in jail terms announced by the president from time to time, the Lahore High Court declared on Friday.

The issue was raised before Justice Chaudhry Ijaz Ahmad by Muhammad Anwar, who is serving a three-year sentence in the Faisalabad jail for attempted rape. He said he was punished under Taazir as Hadd could be imposed under the Offence of Zina Ordinance only if the offence stood committed.

The court upheld the plea and asked the jail authorities to give him the benefit of remissions.

RUET-I-HILAL: The court asked Deputy Attorney-General Yawar Ali Khan to assist it in adjudicating a petition seeking a uniform lunar calendar for the entire Muslim world. Petitioner Khalid Pervaiz said a lot of effort was unnecessarily expended on moon sighting at the beginning of every lunar month. The position of moon can now be scientifically ascertained without actual sighting. He sought a direction to the government to adopt the computerized lunar calendar and also place it before the Organization of Islamic Conference.

ATTACHMENT: The Lahore High Court ordered attachment of all movable and immovable assets of a lawyer who embezzled an insolvent company’s funds as its liquidator.

Lawyer-liquidator SA Askari’s residence in Defence was ordered to be sealed and non-bailable warrants issued for his arrest and production on Nov 23. The Defence area police was asked to arrest and produce any person found visiting or removing any article from the residence. A bailiff sent by the court informed the company judge, Justice Nasir Sikandar, that it was locked.

Advocate Mian Waheed Akhtar, who has been appointed as the new liquidator, was asked to have a case registered against his predecessor for depriving the under-liquidation Himalaya Textile Mills of Rs13.8 million. Bank officials were also to be implicated.

Notices were issued to two other banks which failed to submit details about accounts maintained by Mr Askari with them. The court had earlier frozen all bank accounts of the lawyer.
