MITHI, Aug 8: The district council of Tharparkar, at its session held on Wednesday, unanimously approved a revised land grant policy for the desert (Barani) lands of the district.
Reading the para-wise contents of the policy, Ramsingh Sodho, the convener and the chairman of the land grant policy committee, said the new policy would help a lot in resolving the land related problems of the Thari tenants.
According to the revised policy, no government land shall be allotted within 25 chains (sankli) from a village, 20 chains from “tarai” (rain water reservoir), ten chains from ‘tobho’well/ graveyard/hamlet, whereas no state land within the range of 3 kilo meters from district headquarter, and 2 kilometres from taluka headquarter, including Islamkot and Chelhar town, should be allotted to any grantee.
The details of the policy are as under: Malkano shall be charged from the grantee at the rate of Rs200, per acre, within a period of 60 days, otherwise the grant shall be cancelled. Trees: The grantee reserves all rights over all kinds of tree, including “Rohira”, standing on his “Kabooli” land. There is no need to obtain permission from the competent authority, in this regard. However if any person cuts a tree on state land, he should be penalised and the value of the tree, fixed by the concerned authority, shall be recovered and deposited in the government account.
FRONTAGE (Muhaga): Any land situated within a distance of 10 chains, from Kabuli field, should be considered as “Muhaga” or frontage. The Muhagedar can claim the Muhaga right, of the land, less than the area of Kabooli land.
The persons, who are granted the land permanently, can claim the Muhaga right, provided the land on which the Muhaga is claimed, has been in the possession of the grantee for ten years.
MAKANI/NON-MAKANI: A person, who has resided in a Makan for ten years or who has held the land in the said Makan for twenty years, can be considered as a Makani, whereas a person not falling within the definition of Makani, is considered to be non-Makani.
PANI-DHORE RIGHT: In the desert area, the Pani Dhore (the flow of rain water) is considered important. It should not be distributed, and such grant should be discouraged, specially where the “Talies” (a fertile piece of land lying between two dunes, in a valley) exist.
SANCTION PROCESS: The deputy district officer (Revenue) shall be the competent authority to sanction ‘Tarai’/well, whereas the district officer (Revenue) shall be the competent authority to sanction the village site, Dhani, (a small settlement), Gaucher and “Goha”. Whereas the Mukhtiarkar is competent to sanction a kiln and “Avi” (Khoori).
GAUCHER (GRAZING PASTURE): In every Makan, there should be a “Gaucher” land, on the basis of the number of the livestock and the area of Makan, (if it is already not sanctioned). If state land or “Gaucher” is cultivated by any person, without permission, the standing crop at such area (land) should be destroyed forthwith, at his own expense.
ALLOTMENT OF LAND: The allotment of land under these conditions shall be made by district officer (Revenue) or his nominee, not below the rank of deputy district officer. The district officer (Revenue) or his nominee shall invite applications for allotment of land under these conditions and shall dispose of such applications in an open Katchehry, after inspecting the relevant revenue record personally and making such inquiries, in connection with the eligibility of the applicant, for the allotment of the land.
The schedule of the land available for allotment shall be prepared by the district officer (revenue) in lots, and no allotment should be made without publicity for at least one month before the open katchehry. The land shall be granted to the grantees, keeping in view the points: (a) Muhagedar has first right of Muhaga, (b) Landless Makani Hari (c) Makani Hari owning or holding land, less than 16 acres (equal to 8 acres of barrage land), (d) Makani owning or holding land less than 32 acres (equal to 16 acres of barrage land).
The members of the opposition , congratulated Ramsingh Sodho, for preparing the desert land grant policy, which is to be sent to the government, for final approval.
