KARACHI, Nov 6: A division bench of the Sindh High Court on Tuesday issued notices to the AG and DAG for Nov 13 in a petition, challenging the KMDC’s refusal to accept the “O” and “A” level as equivalent to Higher Secondary School Certificate.

Mr Hasnain, who sought admission to the Karachi Medical and Dental College, maintained that a provisional equivalence certificate was also issued by the Board of Intermediate Education, but at the time of admission, his candidature was rejected as the KMDC refused to recognize the O and A level certificates.

The petitioner had secured 68.7 per cent marks in O and A level examination under the Cambridge System of Examination.

He prayed for declaring Rule(B) of the Eligibility and Procedure of Admission of the KMDC as being discriminatory, illegal and violative of Article 25B of the Constitution.

Another division bench, comprising Chief Justice Sayyed Saeed Ashhad and Justice Mushir Alam, put the health secretary and post-graduate selection committee of the DMC on notice for Nov 13.

Haraish Kumar had challenged the discriminatory attitude of PGC as the committee refused him to give admission in the FCPS Part-II.

PMDC’S REFUSAL: A division bench of the Sindh High Court issued notices to respondents for Nov 13 when a petition filed by Dr Irfan Ahmed Kakezai came up.

The petitioner had challenged the PMDC’s refusal to recognize his post-graduate degree.

The petitioner maintained that he obtained a Ph.D degree from the Central Scientific Research Institute of Dermatology and Venereal Disease, Moscow. He submitted that the PMDC had recognised and registered the same degree of other doctors but he was being discriminated against.

The bench, after hearing initial submissions by Khawaja Naveed Advocate, counsel for petitioner, issued notices to the respondents.

BACHAT BAZAR: A division bench of Sindh High Court on Tuesday granted stay till Nov 12 on a petition filed by Rehmat Ali, owner of a weekly Bazaar challenging the stoppage of the bazaar by the police and the area Nazim, add agencies.

The bench, comprising Justice Ghulam Nabi Soomro and Justice Ataur Rahman, directed the Nazir of the court to inspect the place and submit a report on the next date of hearing.

The petitioner made the SHO of Gulistan-i-Jauhar, Nazim UC-10, town municipal officer, district officer, land revenue department of the Karachi City Government and additional director bureau of supply and prices respondents.

It was the contention of petitioner’s counsel Abdul Hafeez Pirzada that his client was organising the bazaar since 1995 and in 1998 it was shifted to its present place near Aladin Park on a private land owned by Wasif Wazeer Associates.

He submitted that petitioner paid all required fees of Rs10,000 to Nazim UC-10, but the area police on the behest of the Nazim, removed the tents and prevented him from holding the bachat bazaar.

He further contended that the AD of Bureau of Supply and Prices wrote a letter to the Nazim for not disturbing the bazaar as it was a policy of both the federal and provincial governments to ensure supply of essential items to the public at low prices. He prayed to the court to declare the act of police and Nazim UC-10 illegal and without jurisdiction and direct them not to disturb him and restore the bazaar forthwith.

The court will take up this matter on Nov 12.
