KARACHI, July 19: A division bench of the Sindh High Court dismissed on Friday a constitutional petition filed by an assistant executive engineer of the Pakistan Navy as being devoid of merit.

The bench, consisting of Justice Ataur Rahman and Justice Zia Pervez, was seized with the hearing of a petition filed by AEE Abdul Majeed Brohi challenging an order by the Director-General NAB/RAB Sindh under which assets possessed by the petitioner and his family have been frozen.

The petitioner sought immunity maintaining that he was a member of the armed forces of Pakistan, therefore amenable to Field General Court Martial only.

The National Accountability Bureau could not proceed against him, contended the petitioner who allegedly amassed wealth beyond his known sources of income.

Announcing its order on Friday, the court dismissed the petition as having no merit. The court agreed to the contentions and submissions made by Deputy Prosecutor-General NAB/RAB who submitted that bar to the jurisdiction of accountability court was attracted only to those cases of officers who were members of the armed forces of Pakistan. — APP
