PESHAWAR, July 18: A division bench of the Peshawar High Court on Thursday dismissed a habeas corpus petition of a woman, stating that her daughter was in illegal custody of her husband.

The alleged detente, Henna, appeared before the bench on a court notice and stated that she was happy with her husband and did not want to accompany her mother.

The petitioner, Noorjehan, claimed that her daughter was only 14 and was a constant victim of torture and domestic violence. Noorjehan has stated that her daughter, was married to Ibraheem, brother of a spiritual leader of the area, Pir Sufaid.

During last hearing the court had directed the district Mardan police to produce Henna. When Henna was asked whether she was happy with her husband she replied in the affirmative.

Advocate Ali Jamil Qazi appeared for the petitioner and stated that Henna was married about an year ago. He stated that the respondents had not been allowing the petitioner to meet her daughter. Qazi requested the court to remove the girl from her husband’s custody and record her statement after three or four days. He added that Henna was under threat and pressure, due to which she had not been recording proper statement before the court.

However, the bench comprising Justice Abdur Rauf Lughmani and Justice Tallat Qayyum Qureshi did not accept his request and observed that Henna had already stated that she was happy with her husband.

The Henna told newsmen outside the courtroom that she had not met her mother and other family members for the last six months. She added that recently when her parents came to see her, her in-laws fired at them.

However, Henna added that she could not inform the court about these things as her husband had now promised her that he would take her to some foreign country if she remained silent.
