PESHAWAR, April 10: A two-member bench of the Peshawar High Court on Tuesday directed the assistant political agents of Bara (khyber Agency) and Kohat’s Frontier Region (FR) not to arrest a petitioner under the Frontier Crimes Regulations in a monetary dispute between two parties.
The bench, comprising Justice Khalida Rachied and Justice Abdur Rauf Lughmani, also directed the APAs not to take any action against the petitioner, Aurangzaib Khan, on an application filed against him by his opponents.
Advocate Wali Khan Afridi appeared for the petitioner and stated that the act of the APAs were illegal and against the law as under the FCR, political administration was not empowered to interfere in a dispute in settled area.
The petitioner has claimed that on Nov 25, 2000, two applicants Said Rahim and Said Ghani, who were inhabitants of settled area, had filed an application with the APA, FR Kohat, against him and asked the APA to recover 159,500 UAE Dirham outstanding against the petitioner.
He added that after receiving the application the APA issued summons against him.
The petitioner claimed that later the application was also forwarded to the APA, Bara (Khyber Agency), who issued his arrest warrants.
