KARACHI, Nov 1: A girl declared 'kari' by a tribal jirga was on Monday allowed to file her complaint in the Sindh High Court for further action.

Rozina Ujjan submitted through Advocate Shafqat Shah Masoomi that she was declared 'kari' when she and her mother Aisha Khatoon approached the police to register a case against the killers of her father, Azizullah Ujjan. She said two police officials and some of her relatives wanted to grab their father's land in Gambat. They fled to Karachi and sought refuge at Darul Aman here after she was declared 'kari'.

Additional Advocate-General M. Ahmed Pirzada submitted that under the law, an FIR could be registered only by a police station in whose jurisdiction an offence had occurred. The petitioner should have approached the Gambat police station before moving the court, he said.

Petitioner Rozina said the respondents acted in blatant violation of law by holding a jirga and declaring her 'kari'. She wanted to lodge a complaint against them but if she went to Gambat, she might be killed. She said the police had earlier declined to record her mother's complaint in respect of her father's murder because two of its own officials were involved.

Justice Anwar Zaheer Jamali allowed her to file a complaint in the court for appropriate action. Her counsel promptly complied with the direction.

The judge had last week directed the Saddar police to register a second FIR in Azizullah Ujjan's murder case on Aisha's complaint if her version disclosed a cognizable offence. He also ordered that all formalities in respect of the registration of the murder case would be completed in Karachi and investigations would be entrusted by the Karachi DIG concerned to an 'independent and honest' officer, who shall complete the assignment at the earliest.

Petitioner Aisha had alleged that instead of recording her complaint, the police registered a 'collusive and concocted FIR' at the behest of her tormentors, who threatened to kill her and her daughter if she tried to prosecute the culprits nominated as accused in her complaint.

The hearing was adjourned to Nov 4.
