KARACHI, July 22: A division bench of the Sindh High Court, comprising Justice Mushir Alam and Gulzar Ahmed, on Thursday issued notice to Ufone mobile company and deputy attorney general for July 29 in a constitutional petition filed by three residents of Defence Housing Authority.

Dr Nazir Ahmed Chaudhry, a Rhodes scholar, Shahid Paracha, vice president, Pakistan Tanners' Association and Bushra Hassan, all residents of bungalows in DHA Central Lane moved the court, citing communications secretary, PTCL chairman, GM STR-IV, DE, Phones, Ufone Pak Telecomm, DHA and Cantt Executive Officer against construction and installation of a 200 feet high tower.

The petitioners maintained that the area is purely a residential one and installation of a high tower, with heavy-duty generator and other equipment and maintenance works, would expose other residents to a number of hazards.

The bench, after hearing initial arguments, issued notices to all respondents, besides DAG for July 29.

LINK ROAD: The Sindh High Court on Thursday adjourned hearing of a lawsuit filed against blocking of a link road, straight from main University Road to Faizan-i-Madina mosque at old Sabzimandi.

The counsel for the City District Government Karachi requested time to file comments. Justice Maqbool Baqar of SHC, granting the request of the counsel, adjourned the hearing for a date to be fixed by the office.

Earlier, the SHC restrained the CDGK from blocking the link road till July 22, on an application filed by the Dawat-i-Islami Trust.

The Trust which owns a building (No 17/2) of 10,000 square yards at Jail Quarters at old Sabzimandi, stated that its Waqf property Madressah and mosque are established and scores of visitors and students use the premises.

The contention of the plaintiff was that the CDGK intends to amalgamate a 50 feet wide road for a public park on the land of old Sabzimandi, which also is the way for approaching the plaintiff's premises.

It was stated that the defendants are not permitted by law to deprive the people of their right of passage.

The court was prayed to restrain the defendants from closing down, permanently or temporarily the link road, approaching directly from plaintiff's premises to main University Road.

HARASSMENT: A division bench of High Court of Sindh, comprising Justice Mushir Alam and Justice Gulzar Ahmed, on Thursday disposed of a constitutional petition filed by the Inter-City Coach Owners Welfare Association against alleged harassment by the Karachi Traffic Police.

When the petition came up for hearing, Anwar Mansoor Khan, AG Sindh, appearing before the bench, along with DIG Traffic, Karachi M Yamin Khan, stated that as per route permit, petitioners cannot halt their buses or coaches at any designated halt for a maximum time of five minutes.

As a result of violations by the members of the petitioner association, a number of traffic hurdles, including menace of illegal coach/bus stands emerge adding to traffic congestion.

As the counsel for petitioner did not press the petition after this statement by the AG Sindh, the bench disposed of the petition. In case of violation, action may be taken against the bus operators, the bench ordered.
