HYDERABAD, Feb 23: The Sindh High Court, Hyderabad circuit bench, on Tuesday directed the superintendent of the special prison Nara to appear in the court on March 3 in connection with the case of an under-trial prisoner , Khamiso Shar, son of Allah Bachayo, who was not produced in the trial court since Dec 23.

The court observed that the comments filed by the prison superintendent were not only incomplete but evasive. It said the court order passed on Feb 8 had not been complied with.

In his application the prisoner stated that he was challaned by the Nooriabad police two years back and that in FIR the name of real accused was mentioned as Illahi Bux, son of Murad Khoso, while his name was Khamiso son of Allah Bachayo and despite this anomaly he had been implicated in the case.

He said that his family could not bear court expenses as they were poor. He appealed to the court to order an inquiry into registration of case so that justice could be ensured to him.

The additional sessions Judge Kotri told the court that he was challenged before the judicial magistrate Kotri on April 21 under section 17(3) of Hudood Ordinance lodged at the Nooriabad police station. He said that co-accused Inayat alias Ghulam Rasool, Illahi Bux alias Khamiso confined in the jail.
