SHC sets aside bail cancellation order

KARACHI, Feb 14: The Sindh High Court on Monday discharging surety of ex-senator Asif Ali Zardari set aside the bail cancellation order of the Karachi Central sessions judge in Justice Nizam Ahmed murder case.

The district and sessions judge, Central, had on Dec 21, 2004, cancelled the bail of Mr Zardari for his non-appearance before the court and ordered his re-arrest. The trial court order was challenged in the SHC and the court suspended the trial court order giving Mr Zardari a fresh bail on a surety of Rs300,000.

On Monday, SHC's division bench, comprising Justice Sarmad Jalal Osmany and Justice Azizullah M Memon, disposing of an application ordered that the applicant shall remain on bail on previous surety furnished in trial court.

Asif Zardari, Akhtar Javed Pirzada, Bilal Shaikh and Babar Sindhu are charged with killing Justice Nizam Ahmed of Sindh High Court and his son Nadim Ahmed, a lawyer, on June 10, 1996, outside their house in PECHS.

REINSTATED: The Sindh High Court has reinstated three employees of Karachi Stock Exchange with back benefits to them. Adil Abdul Jabbar, Mohammad Farooq Qureshi and Mohammad Hanif Bawani were terminated on July 1, 1994, for protesting against the Benazir government and KSE management.

The petitioners moved the SHC against the order of Sindh Labour Appellate Tribunal. The tribunal, declaring KSE a governmental organization, observed all employees of exchange are civil servants under Section-2A of Civil Service Ordinance 2000 directed the petitioner to file their case in the Federal Service Tribunal.

Allowing the petitions, SHC's division bench, comprising Justice Sabihuddin Ahmed and Justice Khilji Arif Hussain, set aside the tribunal judgment and observed that the KSE is a trade regulatory body and the employees of the exchange are private employees.

The court also reinstated employees with back benefits to them. Syed Shoaun Nabi appeared on behalf of employees while Farooq Ghani represented the KSE management. -PPI
