HYDERABAD, Sept 21: The Sindh High Court, Hyderabad circuit bench, issued on Tuesday notices to the RPO and DPO of Hyderabad, the TPO of Latifabad , SHO Ayub Durrani and sub-inspector Rana Gulsher of the A-section police for September 28 on a petition seeking registration of an FIR against the SHO and sub-inspector for reporting a fake encounter.

Waheeda Begum has filed the petition through Ayaz Latif Palijo advocate. According to her, Abid, Waseem and Aijaz, friends of her son Mazhar came to their house to offer condolence on the death of his daughter on September 10. Shahzad, resident of the area, came and asked them to accompany him to settle a monetary dispute with a man.

Mazhar accompanied him with his friends to some place at 10pm but person concerned was not there. Shahzad came back again saying that the person had arrived and Mazhar with friends visited the person in question, who asked them to hold talks in his house.

Shahzad left, promising to return, and the door remained opened. Shahzad's departure was followed by the arrival of police who started torturing those present there, resulting in fracture of Mazhar's leg.

Sub-inspector Khan opened fire on Mazhar and Aijaz and both suffered injuries. They were taken to the Civil Hospital at 5.55am without any police letter. Police alleged that the persons had opened fire on police constable Nadeem.

Police returned fire and an encounter took place. She said that Nadeem was actually shot at by Gulsher with his service gun and admitted to the Bhitai hospital.

She alleged that police had foisted an unlicensed weapon upon Aijaz, Waseem and Abid and a knife on Mazhar and they were booked in fabricated cases of arms, attempted murder, dacoity and encounter by the sub-inspector.

She said that the incident had taken place at 4:30am on September 11 whereas police came to know about it later while patrolling the area. The police claimed that four persons had entered house of Shahid Ali who was complainant in the cases against four youths.

The complainant is the brother of Raza Ali, wireless operator of the A-section police, and his two cousins, Sohail and Shaukat Ali, are witnesses. She said that contradiction in time of the incident indicated malafide intention of police and false implication of the accused.

She said that an old enmity existed between Mazhar and the police officials. Mazhar's brother-in-law was arrested by the A- section police and he filed a complaint before the director of the Human Rights Board, leading to suspension of a few policemen.

Subsequently, police issued threats of dire consequences which finally led to the incident, she argued and added that Shahzad had not been nominated accused, who had staged the drama.

The petitioner has sought a judicial inquiry into the matter and registration of an FIR against the SHO and sub-inspector. She prayed the court to restrain the SHO and sub-inspector from harassing her son and relatives and the relatives of other accused.

The concerned medical officers of the Bhitai and Civil hospitals should be directed to produce medical certificates of those injured including the police constable, she said.
