ISLAMABAD, Aug 10: A three-member bench of the Supreme Court headed by Justice Iftikhar Mohammad Chaudhry issued notices on Tuesday to two senior advocates of the court for filing a case of a dead person.

The apex court took serious note of this occurrence and issued notices to advocate Chaudhry Afrasiab and Anwar H.Mir, advocate on record, for their negligence and asked to explain about it after the summer vacation of the court.

Both the senior advocates filed a case on Dec 31, 2002, in the Supreme Court regarding a murder case as counsel of the petitioner, Abdul Sattar v/s Shamas Pervez. However, petitioner Abdul Sattar was murdered on March 22, 1998.

The court, comprising Justice Iftikhar Mohammad Chaudhry, Justice Rana Bhagwandas and Justice Mohammad Nawaz Abbasi, during the hearing of the case asked the counsel of the petitioner for the whereabouts of their client.

Even before the counsel of the petitioner say anything, another advocate, Sardar Ishaq, informed the apex court that the petitioner was murdered about five years ago. The apex court surprisingly asked the counsel of the petitioner, "It is very shocking if it is correct."

It may be mentioned here that both the advocates who were issued notices of the negligence also attached statement with the papers book signed by the petitioner even some days before the filing of the case in the Supreme Court. -APP
