KARACHI, Aug 4: A division bench of the Sindh High Court, comprising Justice Anwar Zaheer Jamali and Justice Gulzar Ahmed, on Wednesday adjourned the hearing of a petition by Shabana Khan challenging the transfer of her spouse MPA Younus Khan of Mohajir Qaumi Movement from Karachi to Jacobabad jail.
The court earlier dismissed an application seeking urgent hearing of the petition keeping in view the previous orders passed by the other SHC's division bench which ordered that the matter may be fixed in the first week of August after court vacations.
The petitioner, in the meantime, was directed to file a copy of the FIR with statement and the AAG was asked to place on record comments on the petition. The matter has now been fixed for Aug 11.
Younus Khan, who is facing trial in session court Karachi, was shifted by the jail authorities from Landhi jail to Jacobabad without any reason, the petitioner stated. Her counsel Khurrum Maqsood stated that due to the act of respondents the detainee was not being produced before court to face the trial against him.
The same bench on Wednesday ordered production of a detainee before the court on Thursday. The bench was hearing a constitutional petition filed by Ziarat Ali Amin, father of Zahid Amin, who is confined illegally in Karachi Central Prison despite his bail in all three cases against him registered in the province.
When the petition came up for hearing, AAG Sindh submitted a number of documents to justify the detention of Zahid Amin. The bench, perusing the documents in its order said the "court is not satisfied with these documents, nor with the reply of the AAG ".
The bench directed the Superintendent of Karachi Central Prison to file his reply clearly mentioning the nature of cases against the detainee. The same bench also put of till Aug 11 hearing of a constitutional petition filed by one Khatoon Begum, challenging the transfer of her son Syed Mumtaz Zahid from Karachi Central Prison to Hyderabad Central Prison.
ORDER TO FIA: Justice Amir Hani Muslim of High Court of Sindh on Wednesday directed the FIA officials to conduct investigations strictly according to law.
The bench directed the director of FIA, Mr Askari, to circulate the orders of the court to all FIA officials. The bench was seized with the hearing of a bail application moved by Malik Nazar.
The applicant was arrested by the FIA while leaving for Vienna on a fake Belgian passport. The FIA sleuths found both visa and arrival/exit entries endorsed on the passport to be fake.
During the hearing, the bench asked the investigation officer "how can he you say that passport is fake". The bench also asked whether the IO had examined the FIA officials regarding alleged forged and fake entries.
The IO submitted that he had sent letters to the Belgian authorities and the Pakistan Embassy for a verification. Regarding investigations in respect of fake entries, the IO stated that at present he was conducting investigation in 80 cases and, therefore, could not record the statements of concerned FIA officials.
The court expressed annoyance over the reply. Mehmood Alam Rizvi, standing counsel submitted that the FIA conducted a 24-hour-long investigations during which it was revealed that no record of alleged entries was found which proves that the same are fake and forged.
The bench then admitted the accused to bail against a solvent surety of Rs 100,000 while directing the FIA to remain careful in future and conduct investigations as per procedure. -APP
